By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Description of Service
Review Catalyst automates the process of requesting, responding to, and repurposing Google reviews for your business. We send personalized images via text and email with your customers' names, respond to each review, and repurpose 5-star reviews into social media content that we create and post for you. We integrate into your current process so you don't have to change or do anything.
3. Acceptance of Terms
By accessing and using this Service, you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using this Service's particular services, you shall be subject to any posted guidelines or rules applicable to such services.
4. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party.
5. Acceptable Use
You agree not to use the Service:
For any unlawful purpose or to solicit others to perform such acts
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
To infringe upon or violate our intellectual property rights or the intellectual property rights of others
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
To submit false or misleading information
To upload or transmit viruses or any other type of malicious code

6. Privacy and Data Protection
We prioritize customer data privacy and follow strict security measures. We never use customer data for anything besides reaching out to request reviews on your behalf. We never share or sell any customer information. Your privacy is important to us, and our Privacy Policy explains how we collect, use, and protect your information when you use our Service.
7. Payment Terms
All fees are non-refundable except as expressly stated in these Terms
We operate on a month-to-month basis with no long-term contracts
Text and email expenses are rebilled to you directly at cost
Payment is due monthly in advance
We reserve the right to suspend or terminate your account for non-payment
8. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Rainier Initiatives and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
9. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service. You may cancel your subscription at any time with 30 days' notice.
10. Disclaimer
The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company:
Excludes all representations and warranties relating to this Service and its contents
Excludes all liability for damages arising out of or in connection with your use of this Service
11. Limitation of Liability
In no event shall Rainier Initiatives, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.
12. Indemnification
You agree to defend, indemnify, and hold harmless Rainier Initiatives and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).
13. Governing Law
These Terms shall be interpreted and governed by the laws of the State of Idaho, United States. If a provision of this agreement is or becomes illegal, invalid, or unenforceable in any jurisdiction, that shall not affect the validity or enforceability in that jurisdiction of any other provision or the validity or enforceability in other jurisdictions of that or any other provision.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
15. Customer Support
We provide same-day text and email support. If the issue is complex, we will book a support call to get it sorted. Customer satisfaction is incredibly important to us.
16. Integration and Third-Party Services
We integrate with over 6,000 other apps. Our goal is always to integrate seamlessly so you don't have to change anything - we work in the background. While we can point review requests to Yelp, Angie's List, Facebook, and other review platforms, we recommend and prioritize Google Reviews due to increased local rankings and additional benefits.
17. Review Management
We respond to reviews for you with personalized responses using the reviewer's first name and context from the review
We take responding to negative reviews very seriously, approaching each one with kindness and a proactive attitude
We will always notify you when a negative review is received
We provide analytics and reporting showing all numbers related to your review process
